Hereinafter referred to as "the Buyer", the "Customer" or "You"

The parties agree that their relations will be governed exclusively by this contract, to the exclusion of any condition previously available on the Site. However, if a condition were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector whose companies are headquartered in France.

The Customer acknowledges having read these conditions of sale.

ORDER AND DELIVERY CONDITIONS

Orders

Here are the ordering steps that must be followed by the customer.

However, the steps described below are systematic:

  • Information on the essential characteristics of the Product
  • Choice of the Product, the model according to the dimensions present in the photo gallery of each product
  • Indication of the Customer's essential data (identification, address, etc.)
  • Acceptance of these General Conditions of Sale.
  • Verification of the elements of the order and, if necessary, correction of errors.
  • Follow-up of instructions for payment and payment of products.
  • Delivery of products.

The Customer will then receive an e-mail confirmation of payment for the order, as well as an acknowledgment of receipt of the order confirming it. For the products delivered, this delivery will be made to the address indicated by the Customer.

In accordance with article 1316-1 of the Civil Code, the Customer undertakes to provide his true identification elements. The company Fzy corp, holder of the Yepopy brand, reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.

Pricing

The prices of the items displayed on the site are indicated in Euros and include all taxes (TTC), excluding any delivery costs. Yepopy may modify the prices at any time, but the price invoiced to the Customer is that in force at the time of placing the order, subject to the availability of the items on that date.

For all products shipped outside the European Union and to the DOM-TOMs, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. They will be the responsibility of the Customer and are his full responsibility, both in terms of declarations and payments to the competent authorities and/or bodies of his country.

Payment conditions

Payment is made by credit card or through PayPal. The bank cards accepted are those of the Visa, MasterCard and American Express networks.

Suspicions of fraud

Yepopy reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. In case of fraud or suspicion of fraud, the seller reserves the right to remove any member without notice or compensation.

DELIVERY CONDITIONS AND OUT OF STOCK

Delivery

The Products are delivered to the Customer via Colissimo post within a maximum period of five (7) calendar days from the taking into account of the order (excluding weekends and public holidays), subject to the availability of stock.

Products are generally dispatched within five (5) working days. The Products are delivered to the address indicated by the Customer on the order form.

In any case, the amount of the Delivery costs is indicated to the Customer before the validation of the Order.

Out of stock

In the event of unavailability of the Products after confirmation of the order, the Customer will be informed by e-mail or by telephone as soon as possible and will be refunded the price of the Products within a period of (5) calendar days from the date payment of the sums concerned.

LATE DELIVERY

In the event of non-receipt of a package within the indicative deadlines, the Customer may contact Customer Service who will determine the cause of the delay and communicate it to the Customer. Yepopy will open an investigation to improve this for future orders.

A delay in delivery cannot give rise to any compensation whatsoever, nor to the cancellation of the order in progress, nor to the reimbursement of the latter, if it is proven that the delay was caused by the fact of the Customer or of the recipient of the parcel or of a third party and in cases of force majeure such as those referred to in case law.

Yepopy undertakes to deliver its customer despite the delay. Insofar as the product is lost or the customer has not received his order after proving in writing and postal mail attachments that the product has not been delivered. The Customer will then be reimbursed no later than fourteen (14) days following the date on which the contract was terminated.

Fzy corp undertakes to respect its obligations in terms of guarantees related to the products sold on its Site. We rely on the customer to contact the Customer Service of the company Fzy corp if he considers that the goods delivered do not comply with their destination or because they have hidden defects. It being understood that the legal guarantee of conformity is prescribed after two (2) years from the delivery of the products and that the legal guarantee against hidden defects must be activated by the Customer within two (2) years from the discovery of the hidden defect, it being up to the Customer to prove the existence of the said hidden defect.

The decree of December 18, 2014, Article 3: The general conditions of sale of consumer contracts include in a box the mentions according to which:

“When acting as a legal guarantee of conformity, the consumer:

  •  has a period of two (2) years from the delivery of the goods to act;
  •  can choose between repairing or replacing the good, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
  •  is exempted from providing proof of the existence of the lack of conformity of the goods during the six (6) months following the delivery of the goods. This period is extended to twenty-four (24) months from March 18, 2016, except for second-hand goods.

This same box recalls that the legal guarantee of conformity applies independently of any commercial guarantee granted.

Under the terms of article L.217-4 of the Consumer Code: “The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of its delivery. ".

Under the terms of article L.217-5 of the Consumer Code:

“To be in conformity with the contract, the good must:

1- Be fit for the use usually expected of a similar good and, where applicable: correspond to the description given by the seller and possess the qualities that the latter has presented to the buyer in the form of a sample or model ; present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;

2- Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the seller's attention and which the latter has accepted. ".

Fzy Corp/Yepopy is also bound by the legal guarantee against hidden defects, within the meaning of article 1641 and following of the Civil Code which provides: "The seller is bound by the guarantee for hidden defects of the thing which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid only a lower price for it, if he had known about them”.

The products sold on the Site comply with the regulations and legislation in force in France.

Limitation guarantee

The Customer understands and accepts that the warranty cannot apply in the event of a problem caused by negligence, deterioration (normal wear and tear) or even improper use of the product by him. Indeed, the product sold is intended for incontinence in dogs and urine or heat can deteriorate the internal color of the diaper.

Please note that we cannot accept complaints for the following defects:

  • Wear and tear caused by the daily use of a product.
  • If an item has not been used correctly.
  • Clothes that have shrunk or damaged after washing.
  • Damage caused by improper or heavy use.
  • Perspiration odors.
  • Discoloration.
  • Puffs or lint of a fabric.
  • Damage due to external factors such as friction or chemicals.
  • Items that cause physical discomfort.

TRANSPORT DISPUTE

We ship packages within seven (7) days maximum after the order, the customer is notified immediately by email. Any package NOT RECEIVED must be reported as soon as possible to our team so that we can open a transport investigation. After a period of 30 days after SENDING the package, no complaint can be processed.

Legal withdrawal period

The Customer has a period of fourteen (14) clear days, after the day on which he, or a third party other than the carrier and designated by the Customer, takes physical possession of the goods.

ATTENTION: As these are hygiene products, no product can be taken back if it has been washed and/or worn.

In accordance with Article L. 121-20-2 of the Consumer Code, the following hygiene products will not be taken back if the packaging has been opened: menstrual cups, sanitary napkins, yoni egg, menstrual panties and washable panty liner

To exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs.

When the Products ordered are likely to be delivered in several packages and on different dates, as indicated in article 2.1 of these GCS, the withdrawal period runs from the receipt of the last Product.

Exercise modalities

The Customer must state his wish to return the Product(s) by means of an unambiguous declaration (for example, letter sent by post, fax or e-mail).

The Customer can use the model withdrawal form, but it is not mandatory, or make his request for withdrawal by e-mail (contact@yepopy.com)

Pour que le délai de rétractation soit respecté, il suffit que le Client transmette à Yepopy sa communication relative à l’exercice du droit de rétractation avant l’expiration du délai de rétractation.

For the withdrawal period to be respected, it is sufficient for the Customer to send Yepopy his communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

Returned items must be new and returned in their original packaging. Any damaged item will not be taken back.

REFUND CONDITIONS

The returned Product(s) are fully refunded, including delivery costs (with the exception of additional costs arising from the fact that the Customer has chosen, where applicable, a delivery method other than the less expensive standard delivery method offered), within a maximum period of fourteen (14) days from the date on which Yepopy is informed of the consumer's decision to withdraw.

The returns

In accordance with article L.121-21-4 of the Consumer Code, Yepopy may defer reimbursement until the goods are recovered or until the consumer has provided proof of the shipment of these goods.

Yepopy will proceed with the refund using the same means of payment as that used for the transaction, in any case, this refund will not incur any costs for the Customer.

The withdrawal period as well as the reimbursement period is exceptionally extended during periods when the company is closed, i.e. between July 1 and August 31, as well as December 24 to January 3.

PERSONAL DATA

Yepopy collects personal data from the Buyer as well as, where applicable, that of the recipient of the Order. The purposes, recipients, retention periods and conditions under which Yepopy collects and processes personal data are presented in the policy.

We use this information to provide you with the Services requested and in particular to allow you to place orders on our Site.

This information also allows us to get to know you better and send you personalized offers on our products and those of our partners, subject to your consent when required.

The use of Cookies allows us to improve the performance of the Site and to display advertising on the Site and third-party sites.

Controls are also carried out to ensure the security of the Site and orders.

PARTIAL NULLITY AND NON-WAIVER

If one or more stipulations of these general conditions are held to be invalid or declared as such pursuant to a law, regulation or final decision of a competent jurisdiction, the other stipulations will retain all their force and all their scope.

The parties then agree to replace the null or invalid clause with a clause which will come closest, in its content, to the clause initially adopted.

APPLICABLE LAW AND JURISDICTION

APPLICABLE LAW

These General Terms and Conditions of Sale are subject to French law.

Attribution de juridiction

Any dispute arising from the formation, interpretation or execution of this Agreement will be subject to the exclusive jurisdiction of the courts.

In the event of difficulty arising during the ordering or delivery of items sold on the Site, the Customer will first contact Yepopy to seek an amicable solution. The Customer has the option of using a conventional mediation procedure or any other alternative method of dispute resolution.

Notwithstanding the foregoing, in the event of a dispute, in accordance with Regulation No. 44/2001 of December 22, 2000:

You will be able to seize either the court of the place where you are domiciled, or the French courts.

Yepopy will be able to seize the court of the place where you are domiciled.

CONSUMER MEDIATOR

In accordance with Articles L152-1 to L.152-5 of the Consumer Code, any consumer has the right to have free recourse to a consumer mediator with a view to the amicable resolution of the dispute between him and a professional.

The buyer confirms that he has, prior to placing the order, read all of the aforementioned information and the General Conditions of Sale.
